TERMS AND CONDITIONS
1. ACCEPTANCE OF TERMS The website https://mahaprasadam.org/ and the brand name Mahaprasadam are owned and operated by Mahaprasadam Trust, a registered Trust under Indian law (hereinafter referred to as “the Trust”). By accessing, browsing, or using this platform to avail of our services, you (the “User”) acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must immediately cease usage of the platform.
2. NATURE OF SERVICE (FACILITATION) Mahaprasadam operates as a service facilitator. We bridge the gap between devotees and religious institutions by procuring sacred Prasad from temples (including but not limited to Kashi Vishwanath, Sankat Mochan, and Maa Annapurna) and facilitating its delivery through third-party logistics partners.
- The Trust does not manufacture, prepare, or alter the Prasad.
- The preparation of Prasad is conducted solely by the respective temple authorities according to their internal traditions and safety standards.
3. USER ELIGIBILITY Use of the platform is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. If you are a minor (under the age of 18), you may use the platform only under the supervision of a parent or legal guardian.
4. ORDERS, PRICING, AND PAYMENTS
- Pricing: All prices listed are inclusive of procurement costs, packaging, and service fees. Since the Trust does not currently fall under the GST threshold, no GST is charged.
- Payment: All transactions are processed through authorized third-party Payment Gateways (PG). Users agree to provide accurate financial information and acknowledge that the Trust is not liable for any unauthorized transactions or technical failures on the PG’s end.
- Confirmation: An order is deemed accepted only after the successful authorization of payment and the issuance of a confirmation receipt via email/SMS.
5. SHIPPING AND LOGISTICS
- The Trust utilizes third-party delivery partners for the transit of Prasad.
- Timelines: While we aim for expedited delivery, arrival times are estimates and may be impacted by weather, religious festivals, or courier delays.
- Address Accuracy: The User is responsible for providing a complete and accurate delivery address. The Trust shall not be liable for non-delivery resulting from incorrect User data.
6. FSSAI AND RELIGIOUS DISCLAIMERS
- Quality Standards: While we ensure that our logistics partners maintain hygiene during transit in accordance with FSSAI guidelines for food handling, the Trust makes no warranties regarding the taste, texture, or composition of the Prasad as prepared by the temple.
- Availability: Prasad availability is subject to temple rituals, timings, and administrative decisions. In the event of non-availability, the Trust’s liability is limited to a 100% refund of the transaction amount.
7. INTELLECTUAL PROPERTY All content on this website, including logos, text, graphics, and images, is the exclusive property of the Trust. Unauthorized use, reproduction, or distribution of this content for commercial purposes is strictly prohibited and may result in legal action.
8. LIMITATION OF LIABILITY To the maximum extent permitted by law, the Trust, its trustees, and employees shall not be liable for any indirect, incidental, or consequential damages arising out of the use of the service or the consumption of the Prasad. Our total liability for any claim shall not exceed the amount paid by the User for the specific order in question.
9. INDEMNIFICATION The User agrees to indemnify and hold the Trust harmless from any claims, losses, or expenses (including legal fees) arising from the User's breach of these terms or misuse of the platform.
10. GOVERNING LAW AND JURISDICTION These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Varanasi, Uttar Pradesh.
